SMS Terms and Conditions

1. Program Description

Aquantis Realty LLC ("Aquantis Realty," "we," "us," or "our") operates an SMS messaging program (the "Program") that allows licensed real estate agents affiliated with Aquantis Realty to communicate with prospective buyers, sellers, tenants, and clients ("you" or "Subscribers") who have initiated contact regarding real estate properties, listings, transactions, or related services.

By opting in to the Program, you agree to these SMS Terms and Conditions and to our Privacy Policy.

2. Consent to Receive Messages

By providing your mobile phone number to Aquantis Realty through any of the methods described below, you expressly consent to receive text messages (SMS and MMS) from Aquantis Realty and its affiliated agents at the phone number you provided. Consent is not a condition of purchasing any property, service, or engaging Aquantis Realty for representation.

You may opt in to the Program by:

  • Texting an Aquantis Realty agent directly using a phone number displayed on a property listing, yard sign, print advertisement, marketing material, or the Aquantis Realty website;
  • Submitting your phone number through a property inquiry form on aquantisrealty.com or affiliated listing platforms and affirmatively consenting to text communication;
  • Verbally requesting text follow-up during a phone call or in-person meeting with an Aquantis Realty agent, with such consent documented in our records;
  • Replying with the keyword START, YES, or SUBSCRIBE to a message from an Aquantis Realty number after a prior opt-out.

3. Message Content

Messages sent through the Program may include, but are not limited to:

  • Responses to your inquiries about specific properties;
  • Property details, pricing, availability, and listing information;
  • Scheduling and confirmation of property showings, open houses, and appointments;
  • Follow-up communications related to active real estate transactions;
  • Documents, links, photos, or videos relevant to your inquiry;
  • Coordination of communications between you, your agent, and third parties (e.g., title companies, lenders, inspectors) involved in your transaction.

4. Message Frequency

Message frequency varies and depends on the nature and duration of your inquiry or transaction. The Program is conversational, not scheduled, and you should expect messages only in response to or in connection with communications you have initiated with an Aquantis Realty agent. A typical Subscriber receives approximately 1–4 messages per month.

5. Message and Data Rates

Message and data rates may apply. Aquantis Realty LLC does not charge a fee to send or receive Program messages, but your mobile carrier may charge you for each message sent or received in accordance with the terms of your wireless service plan. Contact your wireless provider for details about your messaging plan and any applicable fees.

6. Opt-Out (STOP)

You may opt out of the Program at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message you receive from an Aquantis Realty number. After you send the opt-out keyword, you will receive a one-time confirmation message that you have been unsubscribed, after which you will not receive additional messages from that number unless you opt back in.

Opting out of the Program from a specific Aquantis Realty number unsubscribes you from messages sent from that number. If you wish to opt out of all Aquantis Realty SMS communications, please contact us at the information in Section 13.

7. Help (HELP)

For help or more information about the Program at any time, reply HELP to any message you receive from an Aquantis Realty number, or contact us using the information in Section 13. Replying HELP will return a message with contact information and a reminder of how to opt out.

8. Supported Carriers

The Program is available on most major U.S. wireless carriers, including but not limited to AT&T, Verizon Wireless, T-Mobile, U.S. Cellular, Sprint, Boost Mobile, MetroPCS, Cricket Wireless, and Google Fi. Carriers are not liable for delayed or undelivered messages.

9. Device and Compatibility

You are responsible for ensuring that your mobile device is capable of sending and receiving SMS and MMS messages. Aquantis Realty is not responsible for messages that are not delivered, are delayed, or are received in incomplete form due to limitations of your device, your mobile carrier, technical failures, or other circumstances outside our reasonable control.

10. Privacy

Information you provide in connection with the Program — including your mobile phone number, the content of messages you send to us, and metadata associated with your messages — is handled in accordance with our Privacy Policy.

Mobile phone numbers and SMS opt-in information are not shared with third parties or affiliates for marketing purposes. We may share information with service providers acting on our behalf (such as our SMS messaging platform provider) solely to operate the Program, and as otherwise required by law.

11. Accuracy of Information

You represent and warrant that the mobile phone number you provide to Aquantis Realty is your own, that you are authorized to receive text messages at that number, and that you will promptly notify us if your mobile phone number changes or is reassigned to another individual. You agree to indemnify Aquantis Realty for any claims arising from messages sent to a number you provided that you were not authorized to receive messages on.

12. Modifications and Termination

Aquantis Realty reserves the right to modify, suspend, or terminate the Program, or any portion of it, at any time and without prior notice. We may also modify these SMS Terms and Conditions from time to time; the updated terms will be posted at this URL with a revised "Last Updated" date. Your continued participation in the Program after changes are posted constitutes your acceptance of the updated terms.

14. Disclaimer and Limitation of Liability

The Program is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Aquantis Realty disclaims all warranties, express or implied, regarding the Program, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Aquantis Realty is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in the Program, including but not limited to delayed, undelivered, or misdirected messages.

Information about properties, pricing, and availability sent through the Program is provided for informational purposes only and is subject to change without notice. No message sent through the Program constitutes an offer, contract, or binding commitment with respect to any property or transaction. All real estate transactions are governed by separately executed written agreements.

15. Governing Law

These SMS Terms and Conditions are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes arising out of or relating to the Program or these terms will be resolved exclusively in the state or federal courts located in Palm Beach County, Florida.
